Banned from riding on their own 370 acre property

Northern Rivers City Limits - Motorcycles Not Allowed in It.*

A Northern NSW family have received an order from the Kyogle council to cease riding motorcycles on their own land - rural 370 acre property - after complaints from neighbours.

The Thomas's may now only use a motorcycle on their own private property if it is in conjunction with a farming activity. A council spokesperson has said that they took sound measurements on neighbours property and deemed the noise "offensive" which sparked the ban. The "Protection of the Environment Operations Act" which covers such matters apparently does not state specific targets that must be met, and the Thomas family are seeking to have this clarified.

Whilst it is understandable that some protection is needed against those who may be serial noise pests, it would appear to be a dangerous precedent to issue bans on activities that can be deemed "offensive" without specific limits being enforced.

A read through the comments on the Northern Rivers Echo article on the issue is interesting, the full range of opinion is evident. While we have seen similar stories on smaller more centralised properties, this is the first we have seen on such a large rural property. Makes you wonder how far this type of thing will go.

This world has gone mad! When you can't ride a bike on your own property, the cherade of "individual's freedom" is torn apart in front of our rose-tinted democratic eyes! Communism is still well and truly alive in this country!

The neighbours have to wake up, and stop thinking about them selves, its not like the motorbikes are being riding each and every day. THink about it this way, one day one neighbour can have his quiet and calm day, then the next day, the other neighbour can enjoy a nice ride. The council also has to pull his finger out of his but. the council needs to think realisticly what would be the best choice to make to keep both neighbours happy.

As one who is regularly plagued by off road unlicenced baffle removed or damaged exhausts on MX Bikes. Using every piece of open private land they can find often cutting fences and bolt cutting western Power access gates I can assure you it's no joke. I have three bikes one of which is a 650KLR. Yes the silencer is US forestry approved and it is strangled but what I bought it for it does well and I have been on many outback dirt roads and tracks fully loaded but still with enough power to tour. Sunday's when I would like a bit of peace and quiet all I can here is MX Bikes and unsilenced Quads belting around a one acre property on the other side of the town-site. Parents often winge they've got nowhere to ride primarily because they are to lazy to take their offspring to an area where they can (and there are many). Invariably once the thing is bought its a case of the neighbours can go to hell and it feels like it to.
